The Cabinet of Ministers allowed Ukrenergo to change the terms of contracts for the completion of protective structures
The Cabinet of Ministers has adopted amendments to the rules of public procurement during martial law and within 90 days after its termination to enable Ukrenergo to complete the construction of protective structures at substations. According to the Ministry of Economy, Ukrenergo will now be able to change the essential terms of procurement contracts already concluded if more than 75% of their value is financed by grants, loans or credits from international financial organizations.
This decision applies to contracts signed before April 9, 2024.
"Thanks to this mechanism, Ukraine will be able to complete the construction of protective structures at substations, quickly restore equipment in case of destruction and strengthen the resilience of the power system in the face of military threats," said Deputy Minister of Economy, Environment and Agriculture Andriy Teliupa.
In particular, it is about financing the construction of protective structures for autotransformers as part of the Re-PoWER project.
According to him, these changes will make it possible to adapt the agreements to the rules of international organizations, which is a key condition for obtaining grants and loans from the World Bank, EBRD and other partners.
Previously, international procurement rules applied only to new projects that were initially funded by international organizations.
If the agreement was concluded under Ukrainian law and later co-financed by international organizations, it was impossible to apply their rules.
- On September 26, the Supervisory Board of NPC Ukrenergo dismissed Vitaliy Zaichenko as Chairman of the Board.
- They explained that grounds for resignation of the chairman of the board were procedural violations during the appointment of Zaichenko, which were discovered by the NSSMC, as well as the loss of confidence in him due to "certain events of recent weeks."
- The NEURC stated that the Supervisory Board violated the procedure by dismissing the CEO of the transmission system operator without notice.
