Major Ukrainian energy firm takes regulator to court over non-compliance fine

The Kyiv District Administrative Court opened proceedings on the claim of United Energy LLC to the National Energy and Utilities Regulatory Commission (NEURC), according to the court decision.

One of the largest energy traders of Ukraine asks the court:

→ to recognize as illegal and cancel Resolution No. 1975 of October 26, 2023 issued by the NEURC on the imposition of a fine on United Energy LLC for non-compliance with the requirements of legal acts regulating the functioning of the electricity market;
→ to recognize as illegal and cancel the order of the NEURC No. 292 of October 26, 2023 on the elimination of violations by United Energy LLC.

United Energy LLC is an energy trader associated with the informal "Privat" group of oligarch Ihor Kolomoisky. The company supplies electricity to the businessman's enterprises, in particular to two ferroalloy plants.

In October 2023, United Energy received a fine of almost 1.7 million hryvnias ($44,639) for violating license conditions in 2021-2022.

Before that, the National Anti-Corruption Bureau of Ukraine and the Specialized Anti-Corruption Prosecutor's Office announced the completion of the investigation on the suspicion of three persons in the case of over 176 million hryvnias ($4.6 million) in losses of the state company Centrenergo.

In May 2023, the High Anti-Corruption Court of Ukraine set a bail of 32 million hryvnias ($840,260) for the director of United Energy in the case of Centrenergo's losses.
